EBC10 STARTUP BATTLE - COMPETITION RULES

 

1. EUROPEAN BLOCKCHAIN CONVENTION COLLABORATION IN THE STARTUP BATTLE

The present rules are intended to govern the competition described below, in which a series of awards will be granted to the participant with the best Web3 and blockchain project, among those startups whose purpose is related to the blockchain ecosystem.

The awards will be granted in collaboration between the EUROPEAN BLOCKCHAIN CONVENTION (hereinafter referred to as “EBC“) and the competition partners, in accordance with the requirements and conditions set forth in these rules for the conduct and execution of the Startup Competition (hereinafter referred to as “Startup Battle” or “Competition“) aimed at participants who comply with the established rules governing the competition.

This document is intended to provide an informational basis regarding participation and the collaborative level of the EBC and the partners, and does not constitute any binding relationship regarding the organization of the competition, nor does the EBC assume any responsibility concerning the management, resolution, and awarding of the Competition Prizes by the partners, nor any legal obligations that may be subject to the same. The Startup Battle participants, by their mere participation, understand that any matter related to the organization, management, safety, regulatory compliance, and/or any other aspect related to the delivery of the prizes by the partners must be directed to them.

Hereafter, the EBC and the partners will be jointly referred to as the “Competition Operators.”

The prizes will be awarded during the celebration of the tenth edition of the EBC which will take place on the 25th and 26th of September, 2024, in Barcelona.

 

2. REGISTRATION FOR THE STARTUP BATTLE

The registration and participation in the Startup Battle are completely free of charge, and no capital contribution is required from the participants or the winner.

Participants may register during the period from May 13 to June 30, 2024, by completing the required information in the registration form and accepting these rules, which can be accessed through the following link <EBC10 Startup Battle>.

 

3. APPLICATION REQUIREMENTS

Participants must meet the following criteria for admission to the Startup Battle:

  • Participants must have received funding of less than FIVE MILLION EUROS (€5,000,000.00).
  • Participants must have been founded on or after the fiscal year 2020.
  • Participants must have at least one Minimum Viable Product (MVP).
  • Participants must be related to the Blockchain, crypto, or Web3 industries.
  • Each participant must choose one track for application:
    • DeFi and crypto 
    • AI, analytics, and infrastructure
    • NFT, metaverse, and gaming
    • ReFi and social impact
    • Tokenization and digital assets
  • Each participant must declare that the information provided is accurate and truthful, and is obligated to communicate any modifications or changes that occur.
  • Applications that do not provide all the information requested in these rules will not be considered in the organization’s evaluation process.
  • An essential requirement of these rules is the presence and participation of the winner on the stage of the EBC at no cost, upon request of the Competition Operators.

Additionally, participants who submit a pitch video prior to their selection will be given greater consideration.

 

4. PRIZES

Pursuant to these rules, the prizes will be awarded by the Competition Operators in the following manner:

  • Regarding the EBC:
  • The presentation of their project live on stage at the tenth edition of the EBC;
  • The provision of three (3) general passes for access to EBC10;
  • The mention of their startup and project and the projection of their logo on the website and marketing channels of the EBC;
  • The opportunity for engagement with the international press to promote their winning project;
  • The receipt of benefits from the sponsors of EBC10;

Hereinafter referred to as the “EBC Prize.”

 

5. STARTUP BATTLE PROCESSES

The Competition Operators will announce the fifty (50) finalists of the Startup Battle on July 15, 2024, providing the contestants with the period from July 15 to September 24, 2024, to prepare their projects. Notwithstanding the foregoing, the Competition Operators reserve the right to extend the deadlines until fifty (50) finalists are determined.

The results of the Startup Battle will be published on September 26, 2024, at around 17:00 pm at EBC10.

The Competition Operators will present to the judges a computerized list or computer disk support, including all contestants who have met the previously referenced requirements, evaluating their innovative ideas. The judges and the companies they represent will be announced at a later date.

The Prize will be awarded to a single participant. However, if the winner does not meet any of the requirements set forth herein, the prize will be awarded to the participant who finished in second place, who shall be entitled to receive the Prize on the same terms.

 

6. ANNOUNCEMENT OF THE WINNER

The winner will be announced live at EBC10 on September 26, 2024, at around 17:00 pm.

The presence of the winner at the time of their official appointment during the Startup Battle celebration is mandatory for the awarding of the Prize. Attendance and presence are considered an unavoidable and binding requirement for the delivery of the Prize in accordance with these rules, and non-compliance will result in forfeiture of the right to receive the Prize.

The requirement for the winner’s presence at the time of the announcement is intended to ensure the transparency, legitimacy, and integrity of the selection process and award delivery.

Should the winner not be present and the Prize consequently not be awarded, the EBC Prize and the partners’ Prize will remain with their respective providers.

 

7. SPECIAL CONDITIONS

The Prize awarded in the Startup Battle is personal and non-transferable and in no case may it be subject to trade or economic or other type of compensation. The Competition Operators will not replace any lost or stolen prizes.

The Competition Operators reserve the right to substitute the Prize with another of equal or greater value if deemed necessary, committing, in any case, to publish any such modification in advance via the following website: <European Blockchain Convention | 25-26 Sept 2024 | Barcelona (https://eblockchainconvention.com/european-blockchain-convention-10/)>.

By submitting the application form, the winner expressly consents to being photographed or to having brief audiovisual reports made during the celebration of the EBC, and agrees to the assignment of their image (provided that it is not subsequently transferred to third parties) for inclusion in the publication of the article as well as in any other commercial event of the EBC, as well as their detailed biographical information set forth in the registration form and statements attributed to the contestant for advertising and promotional purposes.

 

8.  TAXATION OF THE PRIZE

The winner shall be responsible for paying any taxes and fees applicable to the Prize received from the Startup Battle in accordance with the relevant tax laws.

 

9. CLAIMS PROCEDURE

By participating in the Startup Battle, contestants accept its rules and the judgment of the Competition Operators regarding the resolution of any issues arising from its conduct.

The period for contesting the Competition results will end three (3) months from the date the winners are notified of the Prize. Claims must be submitted via email to: missgago@eblockchainconvention.com, with the date and time of receipt of the claims being recorded.

The Competition Operators will issue a communication to the claimant, acknowledging receipt of the claim and confirming the claimant’s identity and the deadline of one (1) month from the date of receipt of the claim to respond.

For the resolution of any disputes that may arise concerning the interpretation or application of these rules, both the Competition Operators and the contestants expressly submit to the jurisdiction and competence of the Courts and Tribunals of Barcelona, with an express waiver of any other jurisdiction that may correspond to them.

 

10. LIABILITY REGIME

For the purposes of the Startup Battle and under the established rules, a distinct liability regime applicable to each of the Competition Operators is determined.

As the sole function of the EBC is the delivery of the EBC Prize and the collaboration regarding the provision of space for the execution of the Competition, it is not responsible in any way for any of the following circumstances:

  • Information or events that could pose a potential claim, injury, damage, expenses, or losses to persons or property and/or liabilities of any nature to both the participants and the partners;
  • Any condition caused by events beyond the control of the EBC that could cause the Startup Battle to be interrupted or corrupted;
  • Any claim that a project presentation infringes the intellectual property or proprietary rights of third parties;
  • Any dispute between the participants or between the participants and the partners;
  • Any injury, loss, or damage (compensatory, direct, incidental, consequential, or otherwise) of any kind arising in connection with or as a result of the prize, or the acceptance, possession, or use of the prize, or participation in the Startup Battle;
  • Any other circumstance arising from the participants or the partners;
  • Any damage arising from or caused by the delivery of the partners’ Prize will be the responsibility of the same. The EBC does not assume responsibility arising from the actions, omissions, and/or failures in any sense generated by the partners;
  • The EBC is not responsible for the occurrence of any of the described circumstances or other exceptional or unforeseeable circumstances, or in case of any other legal obligations that may apply in this regard.

Simultaneously, the partners assume full responsibility for delivering their prizes, adhering to the standards of efficiency, diligence, and regulatory compliance required of them, and are not responsible in any way for any of the following circumstances:

  • Information or event that could pose a potential claim, injury, damage, expenses, or losses to persons or property and/or liabilities of any nature to both the participants and the Competition Operators;
  • Any condition caused by events beyond the control of the EBC that could cause the Startup Battle to be interrupted or corrupted;
  • Any claim that a project presentation infringes the intellectual property or proprietary rights of third parties;
  • Any dispute between the participants or between the participants and the EBC;
  • Any injury, loss, or damage (compensatory, direct, incidental, consequential, or otherwise) of any kind arising in connection with or as a result of the prize, or the acceptance, possession, or use of the prize, or participation in the Startup Battle;
  • Any other circumstance arising from the participants or the EBC;
  • Any damage arising from or caused by the delivery of the EBC Prize will be the responsibility of the same. The partners do not assume responsibility arising from the actions, omissions, and/or failures in any sense generated by the EBC.

Any inconvenience or exceptional situation that may arise in the process will be managed in accordance with the terms and conditions previously agreed upon between the involved parties.

 

11. DATA PROTECTION

The data collected will be processed by the EBC for the purpose of managing the participants’ entry into the Startup Battle. Each participant declares that the information provided is accurate and truthful, and is obligated to notify the Competition Operators of any changes or variations that occur.

The basis for processing their data for the purpose of managing participation is the acceptance of the applicable terms or conditions and subsequent participation in the Startup Battle.

Furthermore, the EBC may collect data related to the image, name, and surname of the Competition Winner for promotional purposes. The basis for processing the data for this purpose is based on the legitimate interest of the Competition Operators to improve and/or promote their promotional activities.

Participants are informed that the startup information and pitch deck submitted through the application form will be shared with the partners, who will assist the EBC in selecting the fifty (50) finalists. The EBC will not disclose the contestants’ personal data to third parties.

Personal information will be retained until the effective conclusion of the Competition. Thereafter, contestant data will be properly blocked and retained only for the duration of the applicable statute of limitations, after which it will be deleted.

Each participant may exercise their rights to access, correct, delete, object to, port, or limit the processing of their data by submitting a written request to “SABANA LABS, S.L.” at the postal address Barcelona, 08005, Carrer de Pujades 55, or to the email address missgago@eblockchainconvention.com, indicating their name and surname and attaching a copy of their ID card, passport, or other equivalent identification document. Participants also have the right to file a complaint with the Spanish Data Protection Agency via its website www.aepd.es.

The EBC commits to treating the personal data of the contestants in a strictly confidential manner at all times and only for the purposes outlined in this clause. It will implement necessary technical and organizational measures to ensure the security of its data and prevent its alteration, loss, processing, or unauthorized access, taking into account the state of technology, the nature of the data stored, and the risks to which they are exposed.

 

12. FORCE MAJEURE

The EBC shall not be held liable for any losses, damages, thefts, delays, or any other circumstances attributable to the Internet or third parties that may affect the conduct of the contest. In no event shall the EBC be responsible for the services of any other entity whose participation is necessary for the winner to enjoy the Prize.

 

13. DEPOSITORY
